No.:<\/strong> J20\/2204\/2022<br \/><strong>Contact email:<\/strong> contact@reshapestudiopilates.ro<\/p><br><p>&nbsp;<\/p><br><p><strong>Chapter I \u2013 General Provisions<\/strong><\/p><br><p><strong>Art. 1 \u2013 Purpose<\/strong><\/p><br><p>This document establishes the terms and conditions of use of the website <a href=\"https:\/\/reshapestudiopilates.ro\/en\/\">reshapestudiopilates.ro<\/a>, hereinafter referred to as the &#8220;Site&#8221;, and constitutes a contract between any person accessing this website, hereinafter referred to as the &#8220;User&#8221; and Reshape Studio Pilates, through the legal operator, SERENITY FASHION GLOBAL S.R.L.<\/p><br><p><strong>Art. 2 \u2013 Acceptance of the terms<\/strong><\/p><br><p>Accessing, browsing and\/or using the Site implies unconditional acceptance of these terms and conditions. The use of any service offered by Reshape Studio Pilates implies the express and full acceptance of these provisions, including related policies (privacy policy, cookies policy, cancellation policy, etc.).<\/p><br><p><strong>Art. 3 \u2013 Definitions<\/strong><\/p><br><ul>\r\n<li>\u201cSite\u201d \u2013 the domain reshapestudiopilates.ro and all its subdomains<\/li>\r\n<li>\u201cProvider\u201d \u2013 SERENITY FASHION GLOBAL S.R.L., the entity that owns and operates the Site<\/li>\r\n<li>\u201cClient\u201d \u2013 any natural or legal person who uses the services made available by the Site<\/li>\r\n<li>\u201cServices\u201d \u2013 all products and Pilates class packages offered for sale online<\/li>\r\n<\/ul><br><p>&nbsp;<\/p><br><p><strong>Chapter II \u2013 Conditions of access and use<\/strong><\/p><br><p><strong>Art. 4 \u2013 Account registration<\/strong><\/p><br><p>Creating an account on the Site is necessary to access and reserve the services offered. The account must be created with correct and complete information. Any attempt to create multiple accounts or provide false information will result in suspension of access and cancellation of subscriptions, without refund.<\/p><br><p><strong>Art. 5 \u2013 User liability<\/strong><\/p><br><p>The user is responsible for:<\/p><br><ul>\r\n<li>maintaining the confidentiality of the authentication data;<\/li>\r\n<li>accuracy of the information entered;<\/li>\r\n<li>using his\/her account in a legal and ethical manner;<\/li>\r\n<li>respecting the rules imposed by the Studio during Pilates sessions.<\/li>\r\n<\/ul><br><p>&nbsp;<\/p><br><p><strong>Chapter III \u2013 Intellectual property rights<\/strong><\/p><br><p><strong>Art. 6 \u2013 Content Protection<\/strong><\/p><br><p>The content of the Site, including but not limited to: texts, logos, graphics, images, video materials, page structure, are protected by Law no. 8\/1996 on copyright and related rights. Use without written permission is prohibited and is punishable according to the law.<\/p><br><p><strong>Art. 7 \u2013 Limitations<\/strong><\/p><br><p>It is prohibited:<\/p><br><ul>\r\n<li>reproduction, redistribution or republication of the content without written consent;<\/li>\r\n<li>inclusion of the content within other websites without consent;<\/li>\r\n<li>use of any data mining, scraping or crawler technology on the Site.<\/li>\r\n<\/ul><br><p>&nbsp;<\/p><br><p><strong>Chapter IV \u2013 Services offered and contractual conditions<\/strong><\/p><br><p><strong>Art. 8 \u2013 Description of services<\/strong><\/p><br><p>Reshape Studio Pilates offers wellness and fitness services, through group classes in the studio, based on the Pilates Reformer method. Services can be purchased exclusively online, in the form of subscriptions.<\/p><br><p><strong>Art. 9 \u2013 Appointments and check-in<\/strong><\/p><br><ul>\r\n<li>Reservations are made from the user account;<\/li>\r\n<li>Participation is only possible based on a valid reservation;<\/li>\r\n<li>Check-in is mandatory 10 minutes before the start of the class;<\/li>\r\n<li>Failure or lateness leads to the loss of the session.<\/li>\r\n<\/ul><br><p>&nbsp;<\/p><br><p><strong>Chapter V \u2013 Prices, payments and billing<\/strong><\/p><br><p><strong>Art. 10 \u2013 Prices<\/strong><\/p><br><p>The prices displayed are expressed in RON and do NOT include VAT, as the company is not a VAT payer. Reshape Studio reserves the right to change prices at any time, without prior notice.<\/p><br><p><strong>Art. 11 \u2013 Payment methods<\/strong><\/p><br><p>Payment for services can be made by:<\/p><br><ul>\r\n<li>bank card;<\/li>\r\n<li>bank transfer;<\/li>\r\n<li>cash (only on location, in special cases).<\/li>\r\n<\/ul><br><p>Full payment is required to confirm the reservation.<\/p><br><p><strong>Art. 12 \u2013 Invoicing<\/strong><\/p><br><p>The tax invoice is issued automatically based on the data provided in the user account. The user is responsible for the accuracy of this information.<\/p><br><p>&nbsp;<\/p><br><p><strong>Chapter VI \u2013 Refunds, returns and cancellations<\/strong><\/p><br><p><strong>Art. 13 \u2013 No refunds<\/strong><\/p><br><p>According to art. 16 letter l) of OUG 34\/2014, leisure, wellness or recreational services that require a fixed date are NOT eligible for return. Thus, purchased subscriptions are NOT refundable.<\/p><br><p><strong>Art. 14 \u2013 Suspensions for medical reasons<\/strong><\/p><br><p>Subscriptions can only be suspended based on a medical certificate recommending rest. The document must be sent to contact@reshapestudiopilates.ro, and the suspension will only cover the specified period.<\/p><br><p>&nbsp;<\/p><br><p><strong>Chapter VII \u2013 Personal data protection (GDPR)<\/strong><\/p><br><p><strong>Art. 15 \u2013 Data collection<\/strong><\/p><br><p>The following categories of data are collected:<\/p><br><ul>\r\n<li>identification data (name, surname, email, telephone);<\/li>\r\n<li>usage data (IP, browser, behavior on the site);<\/li>\r\n<li>data necessary for billing.<\/li>\r\n<\/ul><br><p><strong>Art. 16 \u2013 Purpose of processing<\/strong><\/p><br><p>The data is processed for purposes related to:<\/p><br><ul>\r\n<li>account creation and service provision;<\/li>\r\n<li>fulfillment of legal obligations (invoicing, archiving);<\/li>\r\n<li>direct communication with the user (confirmations, notifications);<\/li>\r\n<li>marketing, only with explicit consent.<\/li>\r\n<\/ul><br><p><strong>Art. 17 \u2013 User rights (EU Reg. 2016\/679)<\/strong><\/p><br><p>You have the following rights:<\/p><br><ul>\r\n<li>right to information;<\/li>\r\n<li>right of access;<\/li>\r\n<li>right to rectification;<\/li>\r\n<li>right to erasure (&#8220;right to be forgotten&#8221;);<\/li>\r\n<li>right to restriction;<\/li>\r\n<li>right to portability;<\/li>\r\n<li>right to object;<\/li>\r\n<li>right to withdraw consent;<\/li>\r\n<li>right to lodge a complaint with the ANSPDCP.<\/li>\r\n<\/ul><br><p>&nbsp;<\/p><br><p><strong>Chapter VIII \u2013 Limitation of liability<\/strong><\/p><br><p><strong>Art. 18 \u2013 Access and functionality<\/strong><\/p><br><p>Reshape Studio Pilates does not guarantee that the site will be permanently available, without interruptions or without errors. We reserve the right to temporarily interrupt access for maintenance, updates or security reasons.<\/p><br><p><strong>Art. 19 \u2013 Liability<\/strong><\/p><br><p>The studio is not responsible for:<\/p><br><ul>\r\n<li>injuries caused by failure to follow the instructor&#8217;s instructions;<\/li>\r\n<li>failure to attend sessions for external reasons;<\/li>\r\n<li>lack of physical condition or aggravation of pre-existing conditions.<\/li>\r\n<\/ul><br><p>&nbsp;<\/p><br><p><strong>Chapter IX \u2013 Advertising, newsletters and reviews<\/strong><\/p><br><p><strong>Art. 20 \u2013 Commercial communication<\/strong><\/p><br><p>By creating an account, the user can opt to receive commercial communications. You can unsubscribe at any time via the link in the email or by sending a request to the contact address.<\/p><br><p><strong>Art. 21 \u2013 Reviews and user-generated content<\/strong><\/p><br><p>Users may leave reviews, comments or suggestions, as long as they comply with Romanian law and do not contain vulgar, illegal or offensive content. Reshape Studio has the right to moderate or remove inappropriate content.<\/p><br><p>&nbsp;<\/p><br><p><strong>Chapter X \u2013 Force Majeure<\/strong><\/p><br><p><strong>Art. 22 \u2013 Definition<\/strong><\/p><br><p>Force majeure exempts the party invoking it from liability, if proven. Force majeure is considered to be unforeseeable and unavoidable events, including: pandemics, fires, earthquakes, wars, cyber attacks, server unavailability, etc.<\/p><br><p>&nbsp;<\/p><br><p><strong>Chapter XI \u2013 Dispute resolution<\/strong><\/p><br><p><strong>Art. 23 \u2013 Modality<\/strong><\/p><br><p>Any dispute between the parties will be resolved amicably within 30 days. Otherwise, disputes will be submitted to the competent courts in the municipality of Bucharest.<\/p><br><p>&nbsp;<\/p><br><p><strong>Chapter XII \u2013 Final provisions<\/strong><\/p><br><p><strong>Art. 24 \u2013 Modification of the document<\/strong><\/p><br><p>Reshape Studio Pilates reserves the right to modify these terms and conditions at any time, without prior notice.
